California: Effective Immediately – California ESA Assembly Bill No. 468

Signed written notice regarding new California Bill No. 468 (to be issued by your therapist). If these requirements are not met, your landlord does not have to legally accept your letter. We understand the inconvenience of having to wait to obtain an ESA letter as part of your treatment plan, but encourage you to make sure you are obtaining your letter ethically and legally to ensure there is no threat of eviction or removal of your animal from your home. The Indiana Senate Enrolled Act No. 240 (March 21st, 2018) places additional requirements on individuals seeking an emotional support animal letter.

“Documentation excludes a health service provider whose sole service to the individual is to provide a verification letter in exchange for a fee” – Therefore, documentation submitted on the basis of a single visit to a health care provider solely to obtain a “doctor’s note” will generally not be legally sufficient. (Indiana Senate Enrolled Act No. 240)

• After your initial session, the ESA evaluation session will be scheduled and a determination will be made.

The new Illinois Animal Assistance Act (January 1st, 2020) places additional requirements on individuals seeking an emotional support animal letter.

“Because a therapeutic relationship requires that care services be provided, in good faith, for an individual’s disability, documentation submitted on the basis of a single visit to a health care provider solely to obtain a “doctor’s note” will generally not be legally sufficient.” (Illinois General Assembly, Public Act 101-0518)

Please be aware that due to the new ruling by the Department of Transportation that went into effect onJanuary 11, 2021, airlines no longer have to legally recognize emotional support animals for air travel. Most major airlines are not recognizing ESAs. You acknowledge that you are aware of the limitations an ESA travel letter provides. By the new federal ruling, if you have a dog, you may be able to qualify for a psychiatric service dog recommendation, which we can assist you with. This does not affect ESAs for housing and your landlord is required by federal law to recognize them.
